Terms of Service Agreement
This Terms of Service Agreement (“Agreement”) is entered into by and between SOHO Firewalls (“SOHO,” “we,” “us,” or “our”) and the subscribing user (“Subscriber,” “you,” or “your”). By subscribing to SOHO services, you agree to comply with and be bound by the terms and conditions outlined herein.
1. Subscription Payments
1.1. Payment Obligation: Subscribers agree to pay the agreed subscription fee in full and on time for each billing period. The billing period will be specified during the subscription process.
1.2. Price Adjustments: Any changes to subscription pricing will be communicated to Subscribers at least 30 days in advance before taking effect.
1.3. Cancellation: Subscribers may cancel their subscription at any time through the Stripe platform. Upon cancellation, services will continue until the end of the current billing period. No partial refunds will be issued for unused service periods.
2. Disclaimer of Liability
2.1. No Guarantee Against Cyber Attacks: SOHO services are designed as a preventative measure to reduce the risk of cyber attacks and data breaches. However, SOHO does not guarantee absolute protection against such events.
2.2. Limitation of Liability: SOHO, its affiliates, officers, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use its services, including but not limited to damages for loss of data, cyber attacks, or data breaches.
2.3. General Liability Protection: To the fullest extent permitted by law, SOHO’s total liability to you for all claims under this Agreement shall not exceed the amount paid by you for SOHO services in the 12 months preceding the event giving rise to the claim.
3. No Warranties
3.1. Service Disclaimer: SOHO services and hardware are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
3.2. No Guarantee of Results: SOHO does not warrant that its services or hardware will be uninterrupted, error-free, or completely secure.
4. Rented Equipment
4.1. Return of Equipment: If SOHO provides rented equipment as part of its service, all equipment must be returned in good working condition within 30 calendar days following the cancellation of your subscription.
4.2. Replacement Fees: Failure to return rented equipment within the specified time frame or returning damaged equipment may result in replacement fees. The replacement fees will be outlined in the equipment rental agreement provided during service activation.
5. Prohibited Uses
5.1. Compliance with Laws: Subscribers may not use SOHO services or hardware to engage in any illegal activities, including but not limited to hacking, unauthorized data access, dissemination of malicious software, or any other activity that violates applicable laws or regulations.
5.2. Service Suspension: SOHO reserves the right to suspend or terminate service immediately if a Subscriber is found to be using the service or hardware in violation of this section.
6. General Terms
6.1. Modification of Terms: SOHO reserves the right to update or modify this Agreement at any time. Subscribers will be notified of any changes via email or through the Subscriber account portal. Continued use of SOHO services after such modifications constitutes acceptance of the updated terms.
6.2. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Colorado.
By subscribing to SOHO services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
